📜 End User License Agreement (EULA)

Software: BOTANIKA – Green Nature
Effective date: 12 May 2026

This End User License Agreement ("EULA", "Agreement") is a legal agreement between you ("User") and Mgr. Petr Vitásek ("Author", "Licensor") governing the use of the software BOTANIKA – Green Nature ("Software").

By installing, copying, or using the Software, you agree to the terms of this Agreement. If you do not agree, do not install or use the Software.

1. Definitions

• Software – the application BOTANIKA – Green Nature including all components, updates, data files, images, illustrations, texts, and databases.
• User – a natural or legal person using the Software.
• Device – a computer or compatible hardware where the Software is installed.
• License – the right to use the Software according to the purchased license type.
• Institution – a school or organization using the Software.
• Activation Key – a code enabling full version activation.

2. Grant of License

The Author grants a non-exclusive, non-transferable, revocable license to use the Software according to the purchased license.

• The Software is licensed, not sold.
• A valid license requires proof of purchase and a valid activation key.
• Without activation, the Software runs as a limited trial version.

3. License Types

3.1 Schools (Primary and Secondary)

• Installation on all school computers is permitted.
• Teachers may also install the Software on home devices.
• Use outside the institution is not permitted.
• Not intended for universities.
• Installation on student devices is not allowed.

3.2 Universities and Non-profit Organizations

• Use permitted under individual or institutional licenses.
• Not intended for distribution to students for independent use.
• Installation on student devices is not allowed.

3.3 Individual License

• Installation on up to two devices.
• License is personal and non-transferable.

4. Restrictions

The User may not:

• copy, distribute, sell, rent, or share the Software or activation key,
• modify, translate, reverse engineer, or access the source code,
• extract or reuse any graphical or textual content,
• circumvent technical protection measures.

Violation results in immediate termination of the license.

5. Intellectual Property

The Software is protected by copyright laws. All rights belong to the Author. No ownership is transferred to the User.

6. Updates and Support

• Updates may be provided at the Author’s discretion.
• Features may change over time.
• Support is available via contact information below.

7. Disclaimer of Warranty

The Software is provided "as is" without warranties of any kind, including:

• merchantability,
• fitness for a particular purpose,
• non-infringement,
• accuracy of results.

The User assumes all risks associated with use.

8. Limitation of Liability

• The Author is not liable for indirect or consequential damages.
• Total liability is limited to the license fee paid.

9. Termination

This Agreement terminates automatically if the User violates its terms. Upon termination, all copies of the Software must be removed.

10. Governing Law

This Agreement is governed by the laws of the Czech Republic. Disputes shall be resolved by Czech courts.
