This End User License Agreement (“EULA”, “Agreement”) is a legal agreement between you (“User”) and
Mgr. Petr Vitásek (“Author”, “Licensor”) governing the terms and conditions for the use of the software
BOTANIKA – Green Nature (“Software”).
By installing, copying, or using the Software, you agree to be bound by the terms of this Agreement.
If you do not agree to these terms, do not install or use the Software.
1. Definitions
For the purposes of this Agreement, the following terms shall have the meanings set out below:
- “Software” means the program BOTANIKA – Green Nature, including all of its components, updates, data files, images, illustrations, texts, databases, and other elements.
- “User” means a natural person or legal entity who installs, uses, or otherwise uses the Software under this Agreement.
- “Device” means a computer, laptop, or other compatible hardware device on which the Software may be installed and used.
- “License” means the right to use the Software within the scope set out in this Agreement and corresponding to the purchased license type.
- “Institution” means a school, educational establishment, non-commercial organization, or other entity that uses the Software as part of its activities.
- “Activation Key” means a unique code provided by the Author that enables activation of the full version of the Software.
- “School Microsoft 365 Account” means a Microsoft 365 user account issued by a school that uniquely identifies a pupil or employee of that school and is used to verify authorization to use the Software within the scope of the purchased Multi-User License.
2. Grant of License
The Author grants the User a non-exclusive, non-transferable, and revocable license to install and use the Software within the scope of the purchased license type.
The Software is licensed, not sold.
A valid license requires:
- a paid tax document or proof of purchase,
- a valid Activation Key.
Without an Activation Key, the Software operates only as a time-limited trial version.
3. License Types
3.1 Multi-User License for Primary and Secondary Schools
- Allows installation and use of the Software on all school computers.
- Teachers and other staff members of the school may also use the Software on their home devices in accordance with the terms of this license.
- If the school holds a valid Multi-User License and uses Microsoft 365, pupils and employees of the school may also use the Software on their private or home devices by signing in with a valid School Microsoft 365 Account.
- The authorization to use the Software on home devices lasts only for as long as the user is a pupil or employee of the school and holds a valid School Microsoft 365 Account.
- Activation via a School Microsoft 365 Account is used solely to verify authorization to use the Software under the school’s valid Multi-User License and is intended only for pupils and employees of the licensed school with a valid School Microsoft 365 Account. The processing of data related to activation is described in the Software documentation and the Privacy Policy.
- The license must not be shared with persons who are not pupils or employees of the licensed school.
- This license is not intended for Higher Vocational Schools, universities, or other institutions listed in Section 3.2.
3.2 License for Higher Vocational Schools, Universities, and Non-Commercial Organizations
- The Software may be used under individual licenses or licenses for computer labs.
- The license must not be provided to students for independent use outside the institution.
- Installation on student devices is not permitted.
3.3 Individual License
- Allows installation on up to two devices of one license holder.
- The license is personal and non-transferable.
4. Restrictions
The User must not:
- copy, distribute, sell, rent, lend, sublicense, or otherwise share the Software or the Activation Key,
- modify, translate, decompile, reverse engineer, or attempt to obtain the source code,
- extract, copy, or distribute images, illustrations, or graphical elements contained in the Software,
- circumvent or attempt to circumvent technical protection measures.
A breach of these terms results in immediate termination of the license.
5. Intellectual Property Rights
The Software and all of its components (code, texts, illustrations, databases, graphical elements) are protected by international copyright laws and treaties.
All rights in and to the Software belong to the Author. This Agreement does not transfer any ownership rights to the User.
6. Updates and Technical Support
- The Author may provide updates, fixes, or improvements at his discretion.
- Updates may modify or remove certain features.
- Support is provided through the contact details listed below.
- The Author reserves the right to reasonably update or amend this End User License Agreement. The current version of the EULA is always published on the Author’s website. By continuing to use the Software after the updated version becomes effective, the User agrees to its terms.
7. Disclaimer of Warranties
The Software is provided “as is”, without any warranties, whether express or implied, including:
- warranty of merchantability,
- fitness for a particular purpose,
- non-infringement of third-party rights,
- accuracy or reliability of results.
The User assumes all risks associated with the use of the Software.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Author shall not be liable for any indirect, special, incidental, consequential, or punitive damages, including loss of data, profits, or business interruption.
- The Author’s total liability shall not exceed the amount paid for the license.
9. Termination
This Agreement remains effective until terminated. The license terminates automatically if the User:
- breaches any term of this Agreement,
- unlawfully distributes or modifies the Software.
Upon termination, the User must uninstall and delete all copies of the Software.
10. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the Czech Republic. Any disputes shall be resolved by the courts of the Czech Republic.
